STATEMENT SPYKER CARS N.V. ON FALSE BANKRUPTCY CLAIM

Zeewolde, 28 August 2007 - Spyker Cars N.V., Formula One constructor and manufacturer of exclusive premium sports cars, states the following in reaction to an article in the Algemeen Dagblad of this morning about alleged bankruptcy proceedings instigated by two parties.
The Dutch newspaper AD this morning claimed that a supplier to Spyker Cars N.V. and an individual from Maastricht had sought to force bankruptcy proceedings against the company. Spyker Cars N.V. wishes to state that, after seeking clarification from all parties concerned, this article has no basis in fact.
To clarify:
- The district court at Maastricht has confirmed that no bankruptcy proceedings have been filed against Spyker Cars N.V. by any party at this district court.
- Moreover, due to Spyker Cars N.V. being statutory seated in Zeewolde, any legal proceedings would need to be co-ordinated through the district court in Zwolle-Lelystad. Again, it has been confirmed that no bankruptcy proceedings have been filed against Spyker Cars N.V. by any party at this district court.
- Spyker Cars N.V. does not have knowledge of an individual creditor from Maastricht as claimed in the article.
- Zürich Insurance is a current creditor of Spyker Cars N.V. but is in discussions with the company as to an outstanding payment. They have also confirmed that neither they or any company representing them have filed bankruptcy proceedings against Spyker Cars N.V.
- Bos Incasso, the debt collection agency named in the article has confirmed in a press release this afternoon that they have not been involved in any proceedings against Spyker Cars N.V. – “In several media articles incorrect statements have been attributed to Bos Incasso claiming that the company would be involved in the bankruptcy of Spyker Cars N.V. At Bos Incasso we have no knowledge of this. Moreover, companies receive bankruptcy notification not from a debt collection agency but directly from the relevant district court.”
