Deferral

National supervisory authorities can grant deferrals. A deferral is a postponement of the publication of a transactions that is granted if the transaction meets a number of requirements based on the type of product, the average daily sales of that product and the size of the transaction.

How to apply

You can submit an application for a deferral. You must complete two forms, the application form and the related Excel template, and send these to the AFM. The AFM will only grant the requested deferral if the application is complete and meets the legal requirements. A deferral will be granted per entity for future transactions in financial instruments traded on platforms.

Complete the forms with care

It is important that you complete these forms fully and accurately. The ‘Application form Deferrals for market operators and investment firms operating a trading venue’ form must be signed by the person in your company who has the relevant authority to sign.

Please send both forms by Cryptshare to mifid2_deferral@afm.nl. This platform enables confidential information to be sent in encrypted form.
