Notification and cancellation of a European passport

If a Dutch manager wants to start offering a UCITS across borders in one or more EU Member States, a European passport is required. This then concerns a notification on the basis of Article 93 of the UCITS Directive.

A manager (authorised to this end in the Netherlands) can also apply for a European Passport to provide the investment services individual asset management and advice in another Member State. If the manager wishes to provide these investment services from the Netherlands, a notification under Article 18 of the UCITS Directive is required. If the Dutch manager wishes to establish a branch in another Member State, a notification under Article 17 of the UCITS Directive is required.

Notification of European passport

If you want to provide cross-border services within the European Union, apply for a European Passport from the AFM using a notification form. There are different notification forms depending on whether the UCITS or the manager needs to be notified. A UCITS manager may offer cross-border services only within the scope of its licence.

The AFM does not charge fees for the outgoing notification of a European passport. Within 10 working days of receiving the notification form, the AFM informs the regulatory authority of the Member State where the manager intends to offer the UCITS. In the case of a notification from the manager, the AFM forwards the notification to the foreign regulatory authority within one month. A notification to establish a branch will be forwarded by the AFM within two months.

Cancellation of European passport

If a manager no longer uses a European Passport, this must be notified to the AFM by means of a denotification form. The AFM then notifies the relevant regulatory authority/authorities. The AFM does not charge any fees for this.
