Caribbean Netherlands: Amended Policy Rule on Fitness 2012 available for consultation

The policy rule describes the framework that the Dutch Authority for the Financial Markets (Autoriteit Financiële Markten – AFM) and De Nederlandsche Bank (DNB) use when assessing policymakers in the financial sector. It applies equally to assessments that the AFM and DNB conduct in the Caribbean Netherlands under the Financial Markets (BES) Act (Wet financiële markten BES).

Over the past period, both supervisory authorities identified relevant amendments and incorporated them into the policy rule. They also introduced amendments necessitated by national and European legislative changes. Market participants are invited to respond to the proposed amendments.

The AFM and DNB are making two documents available for consultation. These are:

• The Draft decree 2022 amending the Policy Rule on Fitness 2012 (pdf, 260 kB) (in Dutch). This lists and explains the proposed amendments.
• The draft of the amended text (pdf, 650 kB), including explanatory notes (in Dutch).

How to respond

You can submit your response by email at consultatie@dnb.nl, stating “Consultation response to Policy Rule on Fitness 2022” in the subject line. The deadline for submitting responses is 15 September 2022. We will publish a feedback statement describing how we have dealt with the various responses.

Next steps

Responses received during the consultation round will be assessed and incorporated where needed into the policy rule and explanatory notes. The definitive texts will be published in the Government Gazette. Together with the feedback statement, they will also be posted on the AFM and DNB websites. We expect this to be in late 2022. The amended policy rule will immediately take effect.
