The Jersey Financial Services Commission (the “Commission”) issues this public statement under Article 25(d) of the Financial Services Law.
This statement is made in order to warn investors and others against dealing with unauthorised financial services providers. Spindler has not received authorisation to conduct financial services business within the meaning of the Financial Services Law.
It appears to the Commission that Spindler, as described on the Website, is falsely purporting that it is carrying on, or holding out that it is carrying on, financial service business in Jersey when it is not authorised to do so pursuant to the provisions of the Financial Services Law. Further it appears to the Commission that Spindler is attempting to utilise the website content of Hawksford Trust Company Jersey Limited and its regulated affiliates (together, “Hawksford”); a bona fide registered financial services provider in Jersey.
The Commission wishes the following to be known:
Spindler has never been registered, nor applied for registration, under the Financial Services Law. Therefore any financial services business, as defined in Article 2 of the Financial Services Law and carried out by Spindler since 1 July 1999, is in breach of Article 7 of the Financial Services Law;
Spindler is not connected in any way to Hawksford. Hawksford is authorised by the Commission to conduct regulated activities.
From documentation held by the Commission, it would appear that Spindler and the Website displays warning signs of being set up for a fraudulent purpose.
