Short selling
Net short positions in Dutch financial institutions have to be notified to the AFM. The ban on short selling lapsed on 1 June 2009.
A net short position is the economic interest related to the total subscribed capital of a financial undertaking, whereby an economic benefit is achieved if the price of shares of the relevant financial undertaking drops.
Notification of net short positions that attain, exceed or fall below the threshold values of a quarter percent (0.25%), and every subsequent change of a tenth of a percent (0.10%), must be notified to the AFM.
The AFM sees no reason to take further measures against short selling on the Dutch market, and has discussed that position with other stock exchange regulators in Europe within the context of ESMA.
